Court Approves Sale of Midway Games to Warner Bros.

After months of speculation and legal maneuverings, the sale of Mortal Kombat developer/publisher Midway Games is finally going through. Within the past day, the court overseeing the Chapter 11 bankruptcy of Midway noted that there were no other bidders for Midway's assets, so the only bidder for the company was Warner Bros.. In addition, all objections to the sale (including Threshold's question over IP rights and Vin Diesel's Tigon Entertainment questions about owed payments) were resolved, clearing the way for Warner Bros. to purchase the company. From the Chicago Tribune article:

Warner Bros. had submitted a $33 million bid to buy "substantially all" the assets of Chicago-based Midway. If there had been other bids, the court would have supervised an auction. But no other parties submitted competing bids, Midway stated in a Tuesday court filing.

The judge said Wednesday that the objections to the Warner Bros. deal were resolved, clearing the way for the approval.

Midway's creditors and Thomas agreed in early June to give Thomas a $5 million payment. He bought media magnate Sumner Redstone's 87 percent stake in the video-game manufacturer for $100,000 last year and also assumed $70 million in Midway debt originally owed to National Amusements, Redstone's movie theater chain.

Thomas' secured claim in the Midway bankruptcy was $30 million. He also had a $40 million unsecured claim that is eliminated as part of the settlement.

The only real word on the opinion of the MK developers regarding this development is something Ed Boon said on his Twitter to TRMK's Patrick McCarron: "looking forward to the focus being on the games, making them better and less on the noise surrounding us."

With this development in place, it seems Midway's financial future seems to be more secure. We'll report more as we learn it.

Ditto.

I don't see much sense in letting the guy/company who sat on MK for so long, continue to reap any benefits of a progressive deal. I hope what they did is, settle out of court for royalties & or residuals($), and told him to kick rocks after that. Give 'em a check and show 'em the door out the WB lobby.

Besides, WB's got the resources to handle MK's other media themselves, or hire a newer better company.

No matter, I hope they the squashed the arrogant bug though.

Well, you've got to remember that the judge hearing the case has a duty to uphold the law. So his concern is, who legally has the rights to this property, and not which company is more likely to produce a kick-ass movie any time soon.

It is an interesting question - Midway won't exist anymore, so does WB have the right to terminate the contract between them and Threshold? I don't know what the legal precedent is for something like that.

However, all we as MK fans can hope for, is that regardless of which side wins this won, we will get a kick-ass movie very soon.

You can almost feel the weight being pulled off MK as a whole. Now they can just have fun with it again, and deliver a kick ass experience.

I'm very excited about this news. It's very good to know the MK team will continue to make better games with "less noise surrounding them", and most important of all, everyone keeping their jobs in a bad economy.

Couldn't care less about the movies or the TV shows. They sucked and I've no interest in seeing new ones.

The article itself for Kasanoff said that, "In petitioning the Bankruptcy Court, Kasanoff seeks to block the proposed sale of Mortal Kombat assets to Warner Bros," so since the sale went through, I'm guessing it was resolved in Midway's favour.

This is great news for MK and WB. WB now has a bigtime vid game company and Midway now has a very respectable, good company backing them with the new investment. This is also great news because financially Midway/MK team can afford things like patches, DLC now as well as WB letting the MK team take their time and not rush their games in the future. I see only good things from this transaction.

As for Threshold...pfftt they are greedy, I read about that a few weeks ago. I'd like to know a few things.

A. why the hell wait 10+ years to "sue" Midway?

B. I call their case bs, because not only did they wait forever but I've read last year that Threshold New Line Cinama had complications with Hobbit and Peter Jackson before it was confirmed they would do a movie.... So this isn't the first time they've been involved in "disagreement" due to money. If it doesn't work out, no biggy WB has BIG influence and power in the world of movies. Maybe they alone will support MK3 movie with Boon/MK teams script approval? hmmmm

At any rate, I'm so happy WB got MK for a lot of reasons. No foreign MK nonsense. Sweet
