Go to trmk.org and on the forum Jeff Greeson himself posted it and they are there talking to ed boon himself right now.
We'll need a more specific link....

no it wasnt confirmed.
"We have a specific question for Boon to list the exiting MK characters that will make it into this game. Right now there's nothing we can reveal yet. But considering what looks like Scorpion on Boon's site pretty much confirms he's in. Plus you can't have one ninja without the other...oh wait you can...MK3 had Sub Zero but no Scorpion. Oh well..."
