just because john tobias left doesn't mean that noob saibot has to leave to. He just inspired the character name as well has Ed boon.

Ed Boon and John Tobias were the original creators of Mortal Kombat. Noob Saibot got his name from the backwards spelling of both of their names... Tobias Boon => Noob Saibot.
The two of them were THE masterminds behind the MK series. There were other "big names", like Dan Forden (their chief sound and music engineer), but Boon and Tobias were the heads. They had a falling out, however, and Tobias left the MK world and formed his own renegade video game company, which really hasn't done anything impressive (check out all the news on Tao Feng, that's Tobias' new game). So, now it's just Ed Boon. Hope that helps...

Since Noob Saibot was a creation of both Boon and Tobias, it might not have seemed appropriate to include him as a character in DA since the split of the 2 developers.
I should still think that Midway owned the rights to the character name, and so could use it if they wanted.. but to my way of thinking, it would be inappropriate to include him after the split.
