My Possible Solution to ESRB Issues?
I don't know the exact stipulations demanded by the ESRB, but however maybe a solution to the issue could be resolved in the form of downloadable content? I mean whenever you purchase a game that has online play, isn't there a warning that the rating is subject to change when entering an online community? I know for a fact there is... so simply offer the jokers original fatality as optional content to download. This way the initial release is T, yet should one go online and download the content online, that rating could change. Yeah it would suck paying for cool fatalities that should have been incorporated originally, but its better than watching 40 fatalities like the Flash one released by Midway... Then again ESRB could already have rejected this idea, but it is an avenue worth checking out.

I've never seen it say that the rating was subject to change. Gameplay experience is but never have I seen "rating subject to change." That would defeat the purpose of the ESRB and I'm sure they'd step in somehow if they did something like that.
I think that warning is more centered around warning people that other players online will most likely be swearing a lot, dropping racial slurs, and so forth. It doesn't mean to say that the game itself will alter in gameplay of violence or whatever. While I would personally have no objection to this kind of thing happening, I find it highly unlikely. EDIT: Also, I am reminded of how the Hot Coffee mod in San Andreas was a download and it got the game bumped up from M to AO.

The real solution would've been for gaming to throw itself on the fires in the early days and suffer through a really grim period to prove themselves worthy of industry-wide self-regulation. Then, after a few decades of economic decline and stupidity, they could let the drug crazed hippys do whatever they want and set the world on fire! Then a decade after that companies could independently dismiss the use of the Games Code and label their own stuff.

I know that ESRB want to change rating of GTA: San Andreas, after know the Hot Coffee super-secret option. Probably, if Midway tried to put a Mature rating as DLC, ESRB will try to remove any copies of T rating, and put a M rating in the game (even if you want/can download M rating DLC).
This isn't the solution, the solution is accept the fact that the MK vs DCU is a T rating. Isn't too hard pals.
