Many places will get it before the street date, especially video rental places like Blockbuster, since rental copies have to be opened and transferred to boxes that will be rented out. I worked there, I would know. And unless they changed their rules, employees there CAN rent the game early on their accounts, but they cannot rent to the public before the street date. It's a $10,000 fine.

I just called my local Gamestop (in Blaine, near Minneapolis), and the dude I talked to didn't tell me whether or not they got it in, but told me that ''it will be available on October 5th for reserved customers.'' And I thought - what the hell, the 5th is the official release date, so that's the same day anyone could get it!
What a crock. What good does it really do to pre-order the game if I get it the same day as anyone off of the street? I can understand if it's a hot commodity and you want to make sure you get the game on the release date, just in case they were to sell-out the game before you got a chance to get there. But still.. if a person pre-orders a game 3+ months ahead of time, I think it should be justifiable that as soon as the game comes in, they should be able to buy it.
Stupid laws and rules. It's only a damn video game. Is it really going to hurt anybody by selling it before the release date?? I don't understand the logic behind it all.
